General Terms and Conditions of Sale
The offer and sale of items on our website (www.philpetter.com) are governed by the following General Terms and Conditions of Sale.
Products purchased on www.philpetter.com are sold directly by PHIL PETTER KNITWEAR GmbH (“Seller”), headquartered in Austria, Sala 17, A-6850 Dornbirn, registered in the Commercial Register under FN 14840 z at the Regional Court Feldkirch.
Through our customer service, you can obtain information about our company and the products offered: contact customer service. You will also find information regarding orders, shipping, refunds, and returns of products purchased on www.philpetter.com.

1. Our Business Policy
- The Seller offers products for sale on www.philpetter.com exclusively to consumers.
- A “consumer” is an individual who, in relation to the contracts concluded with the Seller, is acting for purposes outside their trade, business, or profession. Persons who do not fall within this category are asked not to place orders for products offered by the Seller.
- The Seller reserves the right not to process orders received from persons other than “consumers” or orders that do not comply with the Seller’s business policy.
- These General Terms and Conditions of Sale exclusively regulate the offer, transmission, and acceptance of orders placed on www.philpetter.com between users of www.philpetter.com and the Seller.
- These Terms do not apply to services or sales of products from third parties that may appear on www.philpetter.com via links, banners, or other promotional content. Before using services or purchasing products from third parties, please review their terms and conditions, as the Seller is not responsible for services/products provided by third parties or electronic transactions between users and third parties.
2. Conclusion of Contract with the Seller
- To place an order for products on www.philpetter.com, you must complete the electronic order form and submit it to the Seller by telematic means, following the instructions provided.
- The order form contains a summary of these General Terms and Conditions of Sale, product details, pricing (including taxes and charges), payment options, shipping and delivery costs, and withdrawal rights.
- Receipt of your order by the Seller constitutes a contractual offer by the customer. Please check the accuracy of your details before submitting.
- Before submitting the order form, you are required to carefully read the General Terms and Conditions of Sale and save/print them for personal use.
- The order form will be stored in our database for the time required to process your order and in accordance with legal requirements. You may access your order form under “Track Order.”
- You will be given the opportunity to correct any errors before submitting the order form.
- The contract is concluded only when the Seller accepts the customer’s order by dispatching the goods. Contracts are concluded in German.
- If products shown on www.philpetter.com are no longer available at the time of submitting your order, the Seller will notify you promptly and at the latest within 7 (seven) business days from the day after your order was placed. If payment has already been made, the Seller will refund the full amount paid.
- By submitting the order form, the customer unconditionally accepts these Terms and agrees to comply with them in dealings with the Seller. If you do not agree, you should not submit the order form.
- By submitting the order form, you confirm that you know and accept the General Terms, as well as other information on www.philpetter.com, including links to the Terms of Use and Privacy Policy.
- Upon receipt of your order, the Seller will send you a confirmation email with all order details, including the General Terms, product and price details, payment terms, withdrawal rights, and delivery.
3. Warranty, Liability, and Product Pricing
- The Seller offers exclusively PHIL PETTER branded products on its website.
- The Seller does not sell second-hand, counterfeit, or products of lower quality than the corresponding market standard.
- Products are presented on the website as accurately as possible. However, exact color and image representation may vary depending on browser and monitor.
- All products sold via the online shop are subject to statutory warranty rights.
- Prices are subject to change. Please check the final price before submitting your order form.
- The Seller cannot accept orders from countries not listed on the website.
- All products are sold with an attached identification tag. Please do not remove this tag from purchased products.
- The Seller reserves the right to refuse returned products without the original tag, altered, or damaged.
- As required by law, the Seller provides a 24-month warranty for defects in sold products. Customers must notify the Seller of any defect within 2 months from detection. Please contact customer service in such cases. You may request repair, replacement, or, if not possible, a price reduction or contract termination.
4. Payment
- Payment terms are specified in the order form.
- For payments by credit card or PayPal, financial information (e.g., card number, expiry date) is transmitted via encrypted protocol directly to the relevant payment provider without third-party access. The Seller will not use this information except for refunds or in the event of fraud investigation by police authorities.
- The customer’s credit card is charged at the time of order.
- Payments are processed exclusively via “PAYPAL” and “STRIPE.” Their terms and conditions apply.
5. Shipping Costs and Delivery
Details regarding shipping and delivery can be found here. These terms are an integral part of the General Terms and Conditions of Sale and are considered accepted once the order confirmation is sent to the customer.
5.1 Shipping Costs:
- EU – Free shipping via GLS
- Switzerland – Shipping via UPS – €35 / prices charged without Austrian VAT (20%). Possible import duties (customs, import VAT, brokerage fees) are billed by UPS directly to the recipient and must be borne by the recipient.
- Worldwide – Shipping via UPS – €75 / prices charged without Austrian VAT. Possible import duties (customs, import VAT, brokerage fees) are billed by UPS directly to the recipient and must be borne by the recipient.
5.2 Delivery Times:
- Austria – 1 to 2 business days after payment
- EU – 2 to 3 business days after payment
- Switzerland – 3 to 4 business days after payment
- Delivery times to other countries must be requested individually.

7. Right of Withdrawal
You may withdraw from this contract within 14 days without stating any reason by making an explicit declaration. The withdrawal period begins on the day you or a third party other than the carrier takes possession of the last item.

You may use the withdrawal form provided on our website, but it is not mandatory. If you submit the electronic withdrawal form, receipt will be confirmed immediately by email.
Consequences of Withdrawal
In the event of a valid withdrawal, all payments received must be refunded, including delivery costs (except additional costs arising from choosing a delivery method other than the cheapest standard option offered). Refunds will be made within 14 days using the same payment method as used for the original transaction. The Seller may withhold refunds until goods are received back or proof of return is provided.
The customer must return the goods within 14 days of notifying the Seller of the withdrawal. Return shipping costs are borne by the customer. The customer is only liable for any loss in value of the goods if this is due to handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
8. Refunds and Conditions
- Upon return, the Seller will check compliance with withdrawal conditions.
- Refunds will be issued within 14 days of receipt of withdrawal, but may be withheld until goods are received or proof of return is provided.
- If the recipient differs from the person who made payment, refunds will be made to the payer.

These General Terms and Conditions of Sale may be updated occasionally. The new terms are valid from the date of publication on www.philpetter.com.
